Terms of Service

These Terms of Service govern your use of LushAI, an AI-assisted garden-design service operated at lushai.design by SoftMediaTec GmbH (“LushAI”, “we”, “us”). By creating an account or using the service, you agree to these terms.

1. About the service

LushAI lets you upload images of your outdoor spaces, place design elements, and generate photorealistic garden-design visualizations using third-party AI image-generation providers. The service is intended for inspiration and planning purposes only.

2. Eligibility and account

You must be at least 18 years old or of legal age in your jurisdiction to use the service. You are responsible for keeping your credentials confidential and for all activity under your account.

3. Acceptable use

You agree not to use the service to:

• upload or generate unlawful, infringing, or offensive content;
• violate the intellectual-property rights of others;
• reverse-engineer, overload through automation, or otherwise abuse the service;
• upload images of people without their consent.

4. Your content

You retain all rights to the content you upload (e.g. photos of your garden). You grant us a limited license to process that content in order to provide the service. You may use the visualizations you generate for your own purposes, including commercial ones. For details on AI-generated content, see our AI Content Disclaimer.

5. Subscriptions and payment

Paid plans are billed through our payment processor. Prices, billing periods, and included features are shown at the point of purchase. Subscriptions renew automatically unless you cancel before the end of the current period. Statutory withdrawal rights remain unaffected.

6. Disclaimer of warranties

The service is provided “as is”. AI-generated visualizations are not construction, architectural, or planting plans and do not guarantee real-world accuracy. To the extent permitted by law, we disclaim all warranties of accuracy, fitness, or availability.

7. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, or consequential damages. Our liability for ordinary negligence is limited to foreseeable damages typical for this type of contract. Liability for intent, gross negligence, and injury to life, body, or health remains unaffected.

8. Termination

You may close your account at any time. We may suspend or terminate access for violations of these terms.

9. Changes

We may update these terms. We will notify you of material changes in good time. Continued use constitutes acceptance.

10. Governing law

These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection rules of your country of residence remain unaffected.
